What Is Generalized Anxiety Disorder

Anxiety, Depression and Social Security Disability. A Lawyer’s Advice.

According to the American Psychiatric Association, generalized anxiety disorder is excessive anxiety and worry that interferes with daily activities. It occurs on more days than not, for at least six months. The anxiety must be accompanied by at least three of the following six symptoms: restlessness, quickly becoming fatigued, difficulty concentrating, irritability, muscle tension, and sleep disturbance. Often, the worries are related to everyday matters, including job or family responsibilities. Another disorder must not explain the anxiety. It should not be confused with panic disorder, which is characterized by panic attacks .

How To Apply For Disability Benefits For Depression

Applying for benefits begins with filling out the Social Security Disability Application. You can do this over the phone, online, or by walking into your nearest Social Security Office. You will need your Social Security number and proof of your age , along with the names and contact information for any medical professionals that were involved in your treatment or diagnosis. You will also need names and dosages of your medications, medical records, lab results , a summary of where you worked and what was involved in your job, and the most recent W-2 or Federal Tax Return .

The review process can take a while. In many cases, it will take anywhere from 30 to 90 days. Thankfully there is Social Security Disability Back Pay that will be dated to the time of your application. Even so, you will most likely want to line up other resources while you wait for your SSDI Award Letter to arrive.

One of the first things the SSA will do is determine whether or not you are working at a substantial gainful activity level. The SGA level is a threshold to determine if you need financial assistance in the form of SSDI. As of 2020, substantial gainful activity is deemed to be earnings over $1,260, either as wages or as net profit if you are self-employed. If you are legally blind, that threshold is raised to $2,110. You are allowed to deduct Impairment-Related Work Expenses such as medical treatment from your wages or net profit.

How Can I Get Social Security To Approve Disability Benefits For Anxiety

To receive Social Security Disability Insurance benefits for anxiety, you must prove that your condition is totally disabling. This means proving your impairment renders you unable to perform gainful employment. This is a major difference as compared to a private insurance policy or veterans disability compensation, as these will allow for partial disability benefits. With each disability claim, SSA follows a five-step sequential evaluation process. Basically, you must prove total disability in one of two ways:

Social Securitys medical criteria for claiming disability benefits for anxiety disorders are found in the Listing of Impairments for Mental Disorders, subsection §12.06 Anxiety and Obsessive-Compulsive Disorders.

The SSA Listing deals with a group of mental disorders which have anxiety as the essential feature. The spectrum of disorders the SSA evaluates under this category include:

  • Social Anxiety Disorder
  • Sleep disturbance.

2. Panic disorder or agoraphobia, characterized by one or both:

  • Panic attacks followed by a persistent concern or worry about additional panic attacks or their consequences or
  • Disproportionate fear or anxiety about at least two different situations .

3. Obsessive-compulsive disorder, characterized by one or both:

  • Involuntary, time-consuming preoccupation with intrusive, unwanted thoughts or
  • Repetitive behaviors aimed at reducing anxiety.

Ability to:

  • Concentrate, persist or maintain pace
  • Adapt or manage oneself

Inability To Perform Even Unskilled Work

If you can show that you have a marked impairment in any of the abilities required for unskilled work, your SSDI claim has a much greater chance of being approved even in the absence of any physical impairment.

How do you show impairment of ability to perform unskilled work?

You need to show some limitations associated with:

  • Ability to work with others
  • Ability to work at a consistent pace
  • Handle changes

Development of evidence of the above and the associated limitations can be complicated and time-consuming.

For example, how do you show memory deficit or your lack of decision-making skills?

Information from family members about how you behave at home and in social situations can help. Specific work-setting information may be obtained from former supervisors or co-workers if available.

Treating physicians may have made observations or have opinions regarding your ability to perform these basic capacities.

Medications And Side Effects

Does Anxiety Count as a Disability

Serious medications make a serious medical condition more believable. So, you must try all the recommended medications even if you fear the side effects.

If youre not taking antidepressants, then the insurance company will think your symptoms arent serious enough to qualify for disability benefits. Its common for doctors to have you try multiple medications and different dosages to find the right treatment. So, if you have a bad reaction to one medication, you cant refuse the troubleshooting that follows. You have to try all other medications or changing your dosage.

If you have bad reactions to your medications, your medical records must report that in detail. And, if your doctor recommended against a medication, you need to have it documented that the side effects were worse than the condition. Again, you run the risk of denial if you stray from standard treatments without a good reason.

Treatment For Depression And Anxiety

While the causes and symptoms of depression and anxiety can vary, treatment is typically similar for both conditions. First, your doctor may suggest a holistic approach to treatment including exercise, developing a good sleep routine, drinking more water, and starting a nutritious diet.

While some people see improvement with these lifestyle changes, others may need additional treatment to manage their symptoms. Your doctor will likely refer you to therapy with a mental health clinician or licensed clinical social worker. There are different techniques that your therapist may try, including cognitive behavioral therapy, interpersonal therapy, or problem-solving therapy, to see which, if any, work for you.

If symptoms of depression and anxiety persist despite routine therapy appointments, your doctor may prescribe a medication, or refer you to a psychiatrist for a medication evaluation, in order to treat your conditions. There are several different types of medications and, since the two conditions are similar, one medication may be enough to manage both. Your doctors will likely prescribe an antidepressant, an antianxiety medication, a mood stabilizer, or a combination of the three.

While individuals may benefit from just one of these treatment options, many people require all three in order to manage their symptoms and allow them more freedom in their day-to-day life.

Examples of invisible disabilities include, but are not limited to chronic pain, depression, anxiety, fibromyalgia, Crohn’s disease, rheumatoid arthritis, and some back injuries. Types Of Anxiety Disorders

Anxiety disorders come in different varieties. Your doctor or psychologist may have diagnosed you with one or more of the following:

Because many of the symptoms of these disorders overlap, some people are diagnosed with several of these disorders. For example, somebody who needs to repeatedly make sure that the stove is off can experience a panic attack when something prevents them from checking the kitchen.

If you have symptoms of several disorders, the SSA will look at the combined symptoms when determining whether you’re disabled. The more symptoms you experience, the more likely it is that the SSA will consider that, in total, your limitations are disabling.

Gather Medical Evidence To Support Your Disability

The most important aspect of your disability claim will be the objective medical evidence from your treating doctors of your anxiety disorder. For this reason, having a supportive doctor is essential.

Examples of objective medical evidence to support your claim include:

  • Medical records. Any office visit notes, hospitalization records, lab results, or other records from your doctors that substantiate your condition and symptoms should be included in your disability claim. All of your accompanying symptomsemotional and physicalshould be well-documented.
  • A narrative report from your doctor. If your doctor is supportive, consider whether they can write a letter documenting your anxiety disorder and how it prevents you from working. Their report should focus on the frequency and severity of your symptoms, along with the limitations your condition imposes that prevent you from working. Their opinion should be backed up by their examinations and direct observations of you during office visits.
  • A list of your medications, dosages, and their side effects. Records of your medications and side effects will help the insurance company understand how they may impact your ability to work
