What Do I Need To Know About The Va And Social Security Programs

Both Social Security and VA pay disability benefits. However, their programs, processes, and criteria for receiving benefits are very different.

A VA compensation rating of 100% Permanent and Total does not guarantee that you will receive Social Security disability benefits. To be approved for Social Security benefits, you must meet Social Securitys definition of “disability.” To be found disabled:

  • You must be unable to do substantial work because of your medical condition and
  • Your medical condition must have lasted, or be expected to last, at least one year or to result in death.

A Direct-Hire Authority is an appointing authority that the Office of Personnel Management can give to Federal agencies for filling vacancies when a critical hiring need or severe shortage of candidates exists.   • The Mississippi Dept. of Health, Bureau of Vital Statistics is to furnish, without charge, copies of birth and death certificates when they are needed to establish claims for dependency, disability, or survivors benefits for any Veteran who is a legal resident of the State of Mississippi or their claimants.

    Miss. Code Ann., §35-3-9

    The State Bureau of Vital Statistics is to furnish, at no expense, and immediately upon application a certified copy of birth certificates for any person volunteering for service in one of the Armed Forces of the United States. Miss. Code Ann., §41-57- 25

    Chancery and Circuit Clerks are to furnish, without charge, copies of marriage licenses, divorce decrees, adoption decrees and any and all other records when the same are needed to establish claims for dependency, disability or survivors benefits for any Veterans who are legal residents of the State of Mississippi or their claimants. Miss. Code Ann., §35-3-11

    Chancery Clerks shall record, without cost whatsoever to any person of the Armed Forces of the United States residing in the same county, all honorable discharges and all certificates of service of any and all members of the Armed Forces of the United States. Certified copies will be furnished free without cost to the soldier, sailor, marine, coast guardsman, or nurse. Miss. Code Ann., §35-3-13

Additional Benefits for 100 Percent Disabled Veterans

Veterans who qualify for a 100 percent disability rating from the VA are entitled to additional benefits not afforded to other veterans. Below is a list of benefits for 100 percent disabled veterans and their dependents.

The unremarried surviving spouse of the disabled veteran is eligible for the exemption based upon the eligibility of their spouse therefore the spouse must also be a Michigan resident. The exemption will continue only as long as the surviving spouse remains unremarried.

Income Tax Credit for Property Tax Paid

The state’s income tax code provides a tax credit for property tax paid by a disabled veteran or surviving spouse. This benefit varies depending on disability rating and the family’s income. Use the MI-1040CR-2 to apply for the tax credit. Even if no income tax is due, an eligible veteran may still submit a MI-1040CR-2 to receive the income tax credit as a tax refund. Visit the Michigan Department of Treasury website for a copy of the form and the instructions.

Wartime veterans have preference in employment with state agencies or offices, as do widows and children of those killed on active duty. State agencies must practice veterans preference until they have reached 40% veteran employment.

Military Time Credit Towards State Retirement

Compensation 101: What is Disability Compensation?

Virginia offers a free lifetime hunting and fishing license as well as a discounted saltwater license to Virginia-resident 100% disabled veterans. They also offer discounted hunting and freshwater fishing licenses to veterans with at least a 70% VA disability rating.

Veterans with a 100% disability rating are eligible for free admission and parking for the pass holder at Virginia state parks. The pass also covers boat launch and horse trailer parking and a 50% discount on camping, swimming, shelters and equipment rental.

Arizona Veteran Financial Benefits

Income Tax

Active-duty pay is considered tax-free.

Federal payments of up to $3,500.00 per year are tax-free.

Arizona Military Family Relief Fund

The Arizona Military Family Relief Fund can assist veteran families as well as the families of currently deployed service members. Their aim is to aid families suffering financial hardship caused by a service members deployment. The lifetime limit to financial aid is $20,000 for service-members, Veterans, and their families. The emergency assistance limit is up to a $3,000 payment once in a lifetime.

Vehicle License Tax and Registration Fees

License tax and registration fees are waived for 100% Disabled Veterans for one personally owned vehicle. If a veteran attained a vehicle with VA financial aid, they are also exempt from paying license taxes.

If a spouse is listed on the vehicle registration, a 50% fee will be charged.

The tax exemption and fee exemption are extended to a surviving spouse as long as they remain unmarried.

Property Tax

Property tax exemptions are available to widows, widowers, and disabled individuals. The disabled veteran may be eligible for a property tax exemption of up to $3,000 on their primary residence if their total assessment is under $10,000.

Concealed Weapon Permit Fee Exemption For Service

  • Any Veterans having a service-connected disability shall be exempted from concealed weapon permit fees and renewal fees. The Veteran must be a resident of the state for 12 months or longer immediately preceding the filing of the application. However, this residency requirement may be waived, provided the applicant possesses a valid permit from another state, is active military personnel stationed in Mississippi, or is a retired law enforcement officer establishing residency in the state. Miss. Code Ann., §45-9-101

Find the dependent status in the left column that best describes you. Then look for your disability rating in the top row. Your basic monthly rate is where your dependent status and disability rating meet.
