Short Term Disability Insurance For Pregnancy

Most group disability plans are guaranteed issue at every enrollment. This means you can enroll without any medical questions and will be approved regardless of health. However, in exchange for the guaranteed approval, any claims may be subject to whats called a pre-ex, or a pre-existing condition clause.

The most common pre-ex clauses are 3/12, 6/12 and 12/12.

Heres is what the numbers 3/12, 6/12 and 12/12 mean:

A 3/12 pre-ex means that if you file a claim within the first 12 months the policy is in effect, the insurance company will look back 3 months before the policy took effect to see if it was caused by a pre-existing condition. If its a 6/12, then the insurance company will look back 6 months for a pre-existing condition for any claim filed in the first 12 months.

If the condition was pre-existing during the look back period, then the insurance company can deny the claim.

Keep in mind that if you are enrolling in the disability plan in November but the plan takes effect on January 1 that the 12 months begins on January 1 and the look back period would be the three, six or 12 months before the effective date and not the date you enrolled.

If you are pregnant when you enroll, your claim for short term disability will most certainly come in the first 12 months the plan is in effect and therefore, your claim would be denied.

How Does Employment Insurance Work With Short Term Disability

Employment Insurance is a federal benefit that operates very similarly to STD, providing income replacement in the event an accident, illness, or injury prevents you from working. If you become unable to work and have STD through an employer, your STD benefit will take priority over any EI benefits.

Since the coverages work very similarly, were often asked something along the lines of, Why should I have STD if EI already covers me?

While its true that EI offers similar coverage, there are several advantages to a STD plan over EI benefits. EI is not usually as comprehensive an employer-sponsored STD plan, often having longer waiting periods and lower weekly payments. Furthermore, EIs income replacement is taxable to the employee, whereas STD benefits, depending on plan design, are not. Both STD and LTD benefits can be set up as taxable to the employee or non-taxable to the employee .

To receive benefits, you will have to submit a claim to the insurance company. This involves filling out a form, be it a printed version or online. The form will ask the date you last worked, a description of your medical condition, and other pertinent information. Your employer and physician will have to complete sections of the form as well.

Once you submit the claim form, the insurance company will review medical records to determine if you meet the definition of disability as defined in the policy. If your policy does not cover pre-existing conditions, the insurer will look for evidence of undisclosed conditions.

Whats It Like To Return To Work After Short

Depending on your disability, you and your employer will need to sort out different logistical elements when youre ready to get back to work. But thats not the only factor at play heretheres also an emotional and relational element involved when you return to the office after an extended amount of time off.

Companies arent stagnant and, while youre on leave, there might be employees leaving and new team members being added as well as adjustments to strategy or workflow. There were shifts that occurred during my time gone, so I needed to readjust to the changes that had happened, Tiernan says.

In her case, however, Most of it was just emotional and mental fatigue after having spent four months not really on a computer every day or using my brain in that kind of way, she says. But she felt there was an expectation that shed jump back in full force. Looking back, I appreciate that now because I dont think I wouldve been able to transition as well as I had if it had been slow.

Every person and situation is different, though, and you may find that easing back into work is best for you physically and psychologically. So communicate with your employer and your medical team to ensure a smooth transition.

Was The Pregnancy A Pre

The first thing to consider is how long you were with the employer before taking leave for a pregnancy when the Short Term Disability coverage took effect whether you were pregnant before the STD insurance coverage took effect, and whether there is a pre-existing condition exclusion in the short term disability policy.

It is very common for short-term disability policies through employers to consider pregnancy a pre-existing condition. If there is a pre-existing condition exclusion and you were pregnant when the STD coverage took effect, you may not be eligible for STD benefits relating to pregnancy until 12 months after the short-term disability coverage took effect.

Understanding this pre-ex issue is very important when determining whether to purchase short-term disability insurance. You can still buy the policy, but you typically need to pay for it for a full year before you can use it for pre-existing conditions.

The first thing to do is to carefully read the correspondence thats saying its not being approved, Bartolic says. That will tell the person a lot, and will tell them what to do if they disagree with the decision.

Most disability plans in America are covered under the Employee Retirement Income Security Act , which means claims are reviewed through the lens of this federal law. If your plan is covered by ERISA, the law requires that the denied individual be presented with a right to appeal that decision, McDonald says. So be sure to take advantage of the appeals process within the designated time frame.

Interaction With Ei Sickness Benefits

You cant receive EI sickness benefits and short-term disability at the same time. In fact, if you do receive both, you will need to pay some back.

For example, imagine you got EI sickness payments for 2 weeks. Then, you get approved for short-term disability, and they will pay you for those same 2 weeks. This creates an overlap. If theres an overlap, then youll need to pay back the EI program.

After youre approved for short-term disability, youll receive a back payment. Then, you can refund EI using that money.

Maternity leave, also known as family medical leave, is the time off taken by a parent for a birth or adoption. The Family Medical Leave Act entitles most qualifying workers to up to twelve weeks of job-protected medical leave. However, the FMLA guarantees only unpaid leave and doesnt cover those who work for small companies.

Many parents use a combination of sick leave, vacation time, unpaid leave, and short-term disability coverage during the time away from work. If you dont have the needed sick leave, vacation time, and unpaid leave necessary to cover your time away from work, short-term disability can go a long way to covering you for your lost income.

Family & Medical Leave Act

The Family & Medical Leave Act gives eligible employees up to 12 weeks of unpaid time off for a pregnancy-related absence or to take care of a newborn. Taking FMLA is an option for about 60 percent of the workforce, men and women. In 2015, the law was amended to include protections for same-sex couples.

In order to qualify for FMLA benefits:

  • You have to work for a private company that has 50 or more employees .
  • You must have worked for your employer for at least 12 months and for at least 1,250 hours during the previous year .

While the FMLA has it benefits, there’s fine print that’s worth noting:

  • If you work for a company with less than 50 employees or you’re new at your job , you won’t qualify.
  • You may not be guaranteed job security if you’re in the top 10 percent of wage earners at your company within a 75-mile radius of where you live.
  • Because the time off is unpaid, many new moms find they’re not able to take off three months of work without receiving a paycheck.

Is Your Job Protected While You Take Short

Unlike a leave of absence you might take under the Family and Medical Leave Act , short-term disability doesnt offer any direct job protection. Many people are surprised to hear that you can legally be fired from your job while on leave, and you also arent entitled to the exact same position when you return.

However, the Americans With Disabilities Act protects people who meet the ADAs definition of disability, and makes it far more challenging for companies who are covered by ADA to fire an employee due to their disability.

Before terminating an employee, the company must first determine whether or not there are any accommodations they could make that would allow the employee to adequately do their job.

The company must work with the employee to try several variations of accommodations in an effort to find something that works. If theres no reasonable way to enable that person to fulfill the essential responsibilities of their position, only then can the employer explore termination of the employee.

How To Prepare For Maternity Leave

Figure out your plan for leave. Explore all your options for leave, and determine if you’ll be using a combination of FMLA, short-term disability, and paid/unpaid time off and in what order. You also need to know what you can afford , and whether or not your partner, if you have one, plans to take leave too.

Talk to your company’s HR department. Once you tell your boss and colleagues that you’re pregnant, set up a meeting with your HR rep. You need to give at least 30 days’ notice for FMLA, but it’s best to know as far in advance as possible what your options are. This is also a good time to talk to co-workers who also went on leave from your company. Ask them how they structured their leave and how they transitioned back into work.

Fill out all the paperwork. You’ll want to get this done sooner than later . You’ll be required to fill out paperwork for FMLA, separate paperwork for short-term disability, as well as any internal paperwork for your company. You’ll also need a signed note from your healthcare provider, which proves to the government that you gave birth.

Write up a transition plan. This isn’t a legal requirement but more so a courtesy to your colleagues. Try to set aside some time before late into your third trimester to write up a step-by-step document to prepare your team for your absence. It should note important information such as deadlines and client information that someone else will handle while you’re gone.
