U.S. Navy veteran John Macdonalds work to improve the smiles of hundreds of veterans started four years ago, all because of his heart. No, not because of an overwhelming compassion or affection for veteransalthough that is certainly part of itbut because of his actual heart.
Macdonald enlisted in the Navy in 1966, and later joined Underwater Demolition Team 11. He served multiple tours in Vietnam before being honorably discharged in 1970, going on to earn his doctorate in kinesiology and managing a Naval Research Office research dive study.
Between racing in triathlons, raising kids and managing his studies, Macdonald moved home to Missouri with his family in the 1990s and ultimately became a dentist. It was there that, after suffering a heart attack, he first came to DAV for information about Agent Orange exposure. Benefits advocate Thomas Becker in DAVs office in St. Louis filed a successful claim with the Department of Veterans Affairs on Macdonalds behalf in 2018 for coronary artery disease.
I would have never been able to do it on my own, Macdonald said of DAVs assistance navigating the claims process.
He became a DAV life member and started attending meetings, where he got to know other veterans and listened to their concerns. One thing in particular struck him: frequent stories about his fellow veterans difficulties accessing dental care.
I just thought it was something disabled veterans should have, and I thought, I can do it, Macdonald said.

Importantly, some of the benefits that are available for disabled veterans who are totally disabled , are conditioned on the veteran having permanent and total status. VA deems a disability permanent when it is reasonably certain, based on medical evidence, that the level of impairment will continue for the rest of the veterans life. VA should automatically consider whether a veterans condition qualifies for permanent status when adjudicating their claim.
If VA has awarded P& T status for TDIU or the veterans condition it will most likely be indicated in the decision letter. On some Rating Decisions, there is a P& T box that will be checked if the veterans 100% disability is permanent. Total disability based on individual unemployability represents another way in which veterans can be compensated at the 100 percent level. Essentially, if veterans are able to prove that they are unable to secure and maintain substantially gainful employment as a result of their service-connected conditions, they may qualify for TDIU benefits. Again, TDIU pays the same monthly compensation rate as a 100% VA disability rating, which as of December 2021 was $3,332.06.
VA outlines TDIU regulations under 38 CFR § 4.16, which encompasses subsections and . Each subsection sets forth the standard by which veterans may meet the requirements for TDIU. In order to qualify for TDIU under 38 CFR § 4.16, veterans must have:
- One service-connected condition rated at 60% or higher or
- Two or more service-connected conditions, one of which is rated at least 40% disabling, with a combined rating of at least 70%.
Those who do not meet the schedular requirements under 38 CFR § 4.16 may still be considered for TDIU under § 4.16. under this subsection, VA must refer your entitlement to TDIU to the Director of Compensation Service for extraschedular consideration. From there, the VA adjudicators will approve or deny veterans TDIU claims on an extraschedular basis.
