Although an employer can hire a temporary staff person to fill in during an employees absence, the company must allow the employee to return to her previous position or a position that has similar pay and responsibilities.

Women who qualify for Pregnancy Disability Leave may take PDL on an as-needed basis and in small increments rather than at weeks at a time if recommended by their health care providers.

An employer must treat Pregnancy Disability Leave like other temporary disabilities, in that any policies that apply to temporarily disabled workers must also apply to pregnant women.

What Part Of Pregnancy And Maternity Leave Is Covered By Disability Insurance

If your policy covers your pregnancy and maternity leave, the terms of the policy will spell out what is covered for an uncomplicated pregnancy. Application And Approval Process

An employee who is out of work due to a Disability should file a disability claim by entering an application for leave in the Universitys Workday on-line system:

  • Go to Workday “Time Off and Leave” application,
  • Enter the “First Day of Leave” and the “Estimated Last Day of Leave,” and

The employee will then be directed to download the appropriate forms from the . Please note that the employee’s leave request is not complete until the employee provides the FMLA Administrator with the required information, including an updated Physician Certification Form.

The employee must have the employees physician complete a Physician Certification Form and submit the form to the FMLA Administrator within 20 calendar days of the leave request. A delay in the return of the completed Physician Certification Form may cause a delay in the payment of STD benefits.

On the basis of information received, the FMLA Administrator will determine in a timely manner whether the employees health condition constitutes a Disability that may entitle the employee to STD benefits . If such condition exists and all requirements are met, the FMLA Administrator will provide the effective date of the disability and pay any retroactive short-term disability benefits that are due. FML will run concurrently with any STD benefits to which the employee is determined to be entitled but since FML is unpaid, will not result in any additional benefits.

Parents Who Work For The Same Employer

If you are married to someone who works for the same company, your employer can limit your total amount of FMLA leave for parenting to 12 weeks for both of you. However, whatever portion of your own 12 weeks of FMLA leave you dont use for parenting will still be available to you for other reasons, including your own serious health condition.

Example:Dana and her husband Kevin both work for the same employer. Danas doctor takes her off work for the last five weeks of her pregnancy. She uses her remaining seven weeks of FMLA leave for parenting. This means Kevin has only five weeks of parenting leave under the FMLA. However, if he gets sick later, or the baby develops a serious health condition, he will still have seven weeks of FMLA leave to use for these other reasons.

Under the FMLA, this limit applies only to parents who are married to each other. But in Massachusetts, any two people who work for the same employer and take leave for the same child must share their leave. In other words, parents who work for the same employer, whether married to each other or not, may take a total of eight weeks between them, not eight weeks each.
