When And How Can I Apply For Temporary Disability Insurance

What is New York State Short-term Disability?

How do I apply?

If you are currently employed, you will need to complete a DB-450 form, available at .

  • You should fill out and sign Part A.
  • Your doctor or other appropriate health care provider will need to fill out and sign Part B as proof of your disability. You can only receive TDI if you are under the care of an appropriate health care provider.
  • Submit this form to your employer or, if your employer directs you to do so, to your employers disability insurance carrier.

What if Im unemployed?

If you were previously a covered employee and your unemployment began less than 26 weeks before you became disabled, you may be able to receive TDI while unemployed.

  • If you were unemployed for less than 4 weeks before your disability began, submit your DB-450 form to your former employer or their insurance carrier .
  • If you were unemployed for more than 4 weeks, but less than 26 weeks, before your disability began, mail your DB-450 form to: Workers Compensation Board, Disability Benefits Bureau, P.O. Box 9029, Endicott, NY 13761.
  • If you were unemployed for more than 26 weeks before you became disabled, you are generally not eligible for TDI.
  • You must file your claim within 30 days of becoming disabled.

Whos Potentially Eligible For Ssdi

Its important to understand that everyone who works isnt automatically covered under the federal SSDI program. You are likely covered if:

  • You worked five in the last 10 years full-time at a job that withholds FICA taxes from every paycheck. Some people not eligible for SSDI include service-industry workers union members and federal or state employees. In addition, if you stopped working more than five years ago, you also wont qualify for SSDI because once you stop paying your premiums for 60 continuous months, your coverage automatically lapses.
  • Your doctor says your condition will last for at least one year or result in your death. If your condition improves enough for you to start working again in less than 12 months, your claim will be denied.
  • You are at least 18 years old, but younger than 64. If youre too young and havent earned 40 work credits, you might not qualify. Also, if youre already at or past your full retirement age, then youre no longer eligible for SSDI because SSDI converts into regular Social Security payments.

Many New Yorkers do not receive any long-term paid time off work when they are seriously ill, injured, pregnant, or have recently given birth. The State of New Yorks Temporary Disability Insurance program provides regular payments to some who are temporarily unable to work, including those with pregnancy-related disabilities and those workers who need time to recover from childbirth. Sometimes, TDI is called New York Disability Benefits or DB.

Employees and former employees who have been unemployed for fewer than four weeks file a DB-450 form.     So Should I Choose Group Or Individual Long

    As we said earlier, there are typically two ways to obtain disability insurance coverage. One is obtaining coverage through your employer or by purchasing an individual policy from an insurance company directly.

    Who Is Eligible For New York Short

    In order to be eligible for short-term disability benefits, you must have become injured or ill while not at work but must be employed, or recently employed, at the time of illness or injury. Additionally, pregnancy is covered under short-term disability.

    The employees who are covered by disability include:

    • An individual who is working or has recently worked at least four consecutive weeks at a job that is considered to be owned by a “covered employer.”
    • Individuals who change from one covered employer to another covered employer. As long as your employment was continuous, coverage for short-term disability starts on your first day of work.
    • Domestic workers who work 40 hours or more for one employer. An example of this would be a nanny or personal assistant.
    • Individuals who are not employed by a covered employer but elect for voluntary coverage.

    Which Employees Are Covered

    An employee is entitled to coverage if he or she suffers an off-the-job illness, injury, or other disabling event and:

    • the employee has worked for a covered employer for at least four weeks
    • the employee works for a successor of a covered employer
    • the employee is a domestic or personal employee who works at least 40 hours per week for one employer, or
    • the employee works for an employer who has voluntarily elected to provide coverage.

    Protected Leave For Temporary Disability

    Employees who are temporarily disabled may qualify for protected leave under a different law. Employees in New York City can access paid sick leave. Sick leave provides up to 5 days of paid time off for sickness, injuries, or preventative care.

    As TDI does not start coverage until after 7 days of disability, the New York City sick leave can fill that pay gap. However, 5 days is not enough to provide a protected leave over a lengthened period of time.

    What counts as a disability?
