Can I Get Nj Temporary Disability Benefits And Unemployment At The Same Time

Differences Between Permanent & Temporary Disability NJ Attorney Tanya Phillips explains

If you have an illness, injury, pregnancy, or other physical or mental health condition, but you haven’t worked recently and/or you’re collecting unemployment benefits, you might qualify for Disability During Unemployment benefits. DDU is a combination of Temporary Disability and Unemployment Insurance. The benefit amount is calculated similarly to TDI, but you’ll receive 60% of your average weekly wage, instead of the 85% allowed under TDI.

You might be eligible for DDU benefits if you became unable to work more than 14 days after you last worked for an employer who pays into the New Jersey TDI program. If you’ve already been approved for unemployment or family leave benefits, you’ve already met the earnings requirements to receive DDU. If you haven’t, you’ll qualify if you’ve worked for at least 20 weeks earning at least $240 weekly, or if your income for the base year is at least $12,000.

New Jersey How Much Does Disability Pay In Nj

An illness or injury that prevents a person from working may immediately have you thinking about disability benefits available through the Supplemental Security Income and Social Security Disability Insurance programs administered by the Social Security Administration. However, eligibility for disability benefits through SSI or SSDI require a long-term disability that is expected to last for at least 12 months or cause death.

If you cannot work because of a temporary illness or injury or because of pregnancy, and work for a New Jersey employer, you may qualify for disability pay in NJ through the state-managed program. The information that follows introduces you to the program and explains how much disability pay you may be entitled to receive through it.

Keep in mind that it is a program for short-term injuries and illnesses. If you have questions about disability pay in NJ, a disability lawyer at London Disability can evaluate your claim to determine whether you are eligible and explain how much does disability pay in NJ.

Understanding New Jerseys Temporary Disability Benefits Insurance

Since 1948, New Jersey has required employers and employees to pay payroll taxes to fund a wage replacement insurance program for employees who suffer a non-work related sickness or injury that prevents them from working. The Temporary Disability Benefits Law provides qualified employees with up to 26 weeks of partial wage replacement. New Jersey is one of five states, and Puerto Rico, to offer this benefit.

During the Depression in the 1930s, the United States began implementing social insurance programs such as unemployment and Social Security benefits. Federal statutes provided no basis for a system of compensation for wage loss due to short-term sickness or disability that was comparable to the Federal-State system of unemployment insurance. As a result, some states enacted laws that became known as temporary disability insurance or cash sickness insurance. In New Jersey, most workers whose employment is covered by the New Jersey Unemployment Compensation Law are also protected by a mandatory disability insurance program which covers an illness, injury, or disability that is not work related.
