In addition to rights under Ontarios Human Rights Code, the Accessibility for Ontarians with Disabilities Act& the Workplace Safety & Insurance Act, Ontarios courts and administrative tribunals have awarded disabled employees special damages for shoddy treatment.
If you have been disabled at work then you have numerous rights under Ontarios worker compensation laws including the right to be reinstated.
If you have a disability that prevents you from performing all of your job duties then you generally have the right to be accommodated.
If you are showing obvious symptoms of a disability then your employer has a duty to inquire about your accommodation needs.
If your employer has more than 50 employees then it must prepare a written individual accommodation plan for you.
Your employer cannot take your disability into account when making employment related decisions including the decision to terminate your employment.
If you have disclosed a disability to your employer and the employer treats you badly because you are disabled then you may be owed special damages.
If you have been treated differently because you are disabled, or your employer has refused to accommodate your disability, or your employer has refused to bring you back to work following an injury or a disability then you can speak to an employment lawyer about your rights.

What Universal And Inclusive Design Means
While Nikes Go FlyEase shoes are considered to be adaptive fashion, it is not specifically targeted at the disability community. For example, in Nikes press release for the new shoes, the words “disability, disabilities, or disabled, are not mentioned, and “adaptive” is only included once. This is in part because the shoe is universally and inclusively designed, according to Jun.
Its made for more people, and as many people as possible, Jun says. Were not labeling it as only for people with disabilities. Theyve made it into a way where anybody who may want to find easier dressing would be able to wear this shoe.
McBee-Black points out some of the ways the new sneakers can be universally helpful. The designers working on the shoes were talking about how most consumers when they walk to their home at the end of the day, they use their other foot to push the back of the heel of their shoe off, she says.
One of the goals of universal design is to improve accessibility for everyone, including the disability community. There have been criticisms, however, about Nikes decision to not market their adaptive shoe as a disability product.
Adaptive Clothing And The Workplace
A 2018 paper published in the journal Societies suggests that having appropriate adaptive fashion options may increase the participation of disabled people in the workforce. Research has previously found that stigma can play a role in the hiring of disabled people, and how they are treated in the workplace.
The study found that people use appropriate adaptive clothing options for two different reasons. First, some participants want to use accessible clothing in order to fit in. Second, some participants use the clothing to build their confidence. All of the participants also reported they were unable to find appropriate clothing for work.
The papers lead author, McBee-Black, says that the need for different clothing in a work setting is, of course, not unique to the disability community. If you have a job interview, you have to present yourself in a way that is representative of the job youre seeking, she says. If youre someone with a disability, youve not had that option because there have not been any options out there.
The paper suggests that a lack of adaptive clothing plays a large role in disabled people’s access to work, rather than a persons disability.

But the biggest giant in all of sneakers and sportswear hasnt operated alone in innovating for people with disabilities instead, its found a key partner with the same mission in the shape of a sneakers startup based in Utah.
Launched in 2017 by bag industry veteran Michael Pratt, the brand Kizik sought to solve a problem familiar to anyone who wears shoes, slipping them on without using your hands. Six years of development went into developing a heel that would expand and pop back into place as you step into the shoe, eliminating the need to untie or tie laces or peel back the heel in order to jam your heel in.
