Do I Qualify for Disability Benefits If I Have Crohn’s Disease?

If you have lost an excessive amount of weight because of your Crohn’s disease, you can be found disabled under listing 5.08. To qualify under listing 5.08 you must show all of the following.

  • You have lost weight despite continuing treatment as prescribed by your doctor.

Does Crohns Qualify For Long

It is the goal of the SSA to see individuals return to work. If an individuals Crohns disease is severe enough, however, this may not be possible. In this case, the SSA may approve an individual for long-term disability.

The SSA may require regular documentation of ongoing issues related to Crohns disease to continue long-term disability payments. This may include a doctors notes, scans, or other medical tests on a regular basis to prove that problems are persistent.

Individuals with Crohns disease are eligible for the same disability benefits as anyone else with a disability. This includes monetary compensation but may also include other benefits like disabled parking and a tax credit.

How Can I Qualify Under The Inflammatory Bowel Disease Listing

To meet listing 5.06, you must be diagnosed with inflammatory bowel disease and have documentation of one of the following:

Bowel obstruction. You must have an obstruction, other than just adhesions, of narrowed areas in the small intestine or colon, with dilation and swelling. The obstruction must be confirmed by medically acceptable imaging or by surgery and have required hospitalization or surgery to compress the intestines. The obstruction must have occurred at least twice, 60 days apart, within the same 6-month period.

Other qualifying complications. You must have two of the following symptoms, despite adhering to your prescribed treatments. The two complications must happen within the same 6-month period.

Even if your Crohn’s disease does not meet listing 5.06, you may still be found disabled under listing 5.08, weight loss due to digestive disorder.

What If I Don’t Meet An Ssa Listing

Sometimes people with Crohn’s are too sick to work but don’t meet the SSA listing criteria for IBD or weight loss. In this case, you can still be approved for disability, but it may be more difficult. The SSA will look at your documented symptoms to determine at what level you can work: heavy work, medium work, light work, or sedentary work. This is called your residual functional capacity . The SSA will then evaluate whether you are able to do your past work with your RFC rating. If the SSA believes you can do your past work, your claim will be denied.

If the SSA believes you are unable to do your past work, it will next consider your ability to learn and do other jobs given your RFC, and your age, education, and work background. Older, less educated people who worked more sedentary jobs are more likely to be approved at this stage.

To help the SSA assess your RFC correctly, it’s helpful to provide the SSA with an analysis from your treating doctor about how the Crohn’s affects your ability to work. Your doctor can fill out an RFC form to describe your limitations: how long you are able to sit, stand, walk, lift, carry, push and pull, and whether you are required to rest throughout the day and if you need frequent and unscheduled breaks. The more restrictions your RFC reflects, the more likely you are to be approved .

EI sickness benefits are temporary disability benefits paid through the federal governments employment insurance program. EI pays 55% of your salary for 15 weeks. As of January 1, 2022, the maximum amount you can receive in a year is $60,300. This means you can receive a maximum amount of $638 per week.

To qualify, you must have paid into the EI program recently. You pay through deductions from your paycheque. These deductions are automatic. So, if you got an official paycheque, you paid into the EI program.

You apply for EI benefits online through Service Canada, from home or at any Service Canada office. You also need your doctor to fill out a form that confirms your inability to work for 15 weeks. Finally, your employer has to issue a Record of Employment to verify your sick leave.

Several potential environmental risk factors have been linked to Crohns disease. However, more studies need to be done to really understand the risk factors for Crohns disease. Nevertheless, the following environmental factors do contribute to the likelihood of having Crohns disease.

SMOKING: Active smokers are twice as likely as those who do not smoke to develop Crohns disease. Surprisingly, the risk of developing ulcerative colitis is decreased in smokers versus people who have never smoked. However, the numerous potential harmful health effects of smoking, like cancer and heart disease, outweigh any benefits of smoking for people with ulcerative colitis.

ANTIBIOTICS: May increase the risk for IBD.

NONSTEROIDAL ANTI-INFLAMMATORY DRUGS: Nonsteroidal anti-inflammatory drugs such as aspirin, ibuprofen, and naproxen may increase the risk for getting IBD. These drugs may also cause Crohns disease flares.

APPENDICITIS: Children who undergo an appendectomy are less likely to develop ulcerative colitis later in life, but may be at a higher risk of developing Crohns disease. However, the benefits of appendectomy for those who need it outweigh the risks. Especially if those risks include having Crohns disease.

Is Crohns A Primary Or Secondary Rating

A primary rating is a disability that is directly caused by active-duty service. For example, I injured my neck in an incident on active-duty. As a result, my disability for my neck is a primary disability. However, the neck later caused radiculopathy in my arms. The radiculopathy is a rating, but it is secondary to my neck injury.

Crohns disease is a strong claim because it can be either a primary or secondary claim. In fact, many veterans with PTSD develop Crohns or other digestive issues. As a result, veterans with a mental health issue need to pay close attention to their digestive health. The link between mental health and digestive issues is too involved for this post, but there is absolutely a link between the two.

Qualifying With Crohns Disease

The SSA developed a manual or guide known as the Disability Evaluation Under Social Security that lists the requirements necessary for certain conditions to qualify for disability benefits. Part 5.06 Inflammatory of the Blue Book specifies what is needed for an individual with Crohns disease to qualify.

5.06 Inflammatory Bowel Disease

The following must be documented by biopsy, endoscopy, medically acceptable imaging, or operative findings.

Requirement A

Obstruction of stenotic areas in the small intestine or colon with proximal dilatation requiring hospitalization for intestinal decompression or for surgery, and occurring on at least two occasions at least 60 days apart within a consecutive 6 month period.

Requirement B

An applicant must have two of the following despite continuing treatment as prescribed and occurring within the same consecutive 6-month period:

1.) Anemia with hemoglobin of less than 10.0 g/dL present on at least two evaluations at least 60 days apart

2.) Serum albumin of 3.0 g/dL or less present at least two evaluations at least 60 days apart

3.) Tender abdominal mass palpable on physical examination with abdominal pain or cramping that is not completely controlled by prescribed narcotic medication, present on at least two evaluation at least 60 days apart

4.) Perineal disease with a draining abscess or fistula with pain that is not completely controlled by prescribed narcotic medication present on at least two evaluations at least 60 days apart

Ptsd And Crohns Disease

One way to potentially get a service connection for Crohns disease is as a secondary condition to PTSD. As we mentioned, stress can aggravate Crohns disease, and while this isnt a cause, it can certainly make your condition more difficult to manage. If you have a service connection for PTSD, you could connect your Crohns symptoms to that to get compensation.

A secondary service connection means that you have a disease that, while not a direct result of your military service, is a complication of another condition that was caused by your military service. This allows you to get a disability rating for both conditions, as they all tie back to your service record. To apply for federal government disability benefits through the SSA, a person can visit the SSA website, apply by phone, or apply in person at a local office. They will need:

  • proof of diagnosis such as imaging, tests, endoscopy results, or notes from their doctor
  • laboratory tests done within the past year
  • prescription medications taken for Crohns
  • information about doctors they have consulted
  • W-2 forms from the previous year
  • proof of citizenship
  • financial records, bank statements, pay stubs, insurance paperwork, and rent or mortgage paperwork

A person will receive a response through the mail with the SSAs decision. Individuals have the right to appeal a decision within 60 days, in writing.

Meeting Social Security Administration Listing 506a For Crohns Disease

A Social Security disability claimant with Crohns disease meets listing 5.06A and is disabled if he or she has had sufficient narrowing of the intestine.

Listing 5.06A requires two hospitalizations for bowel obstruction at least 60 days apart within a six-month period. This hospitalization requirement means that only the most severe chronic cases qualify under listing 5.06A.

If the complications are eliminated by surgery, then you do not qualify under part A. In many instances, surgery does produce long-term benefit when combined with the proper diet and medication.

What Is The Difference Between Crohns Disease And Ulcerative Colitis

Ulcerative colitis is another form of IBD . Unlike Crohns disease, it affects only a limited amount of the gastrointestinal tract, typically the colon and rectum, and harms only the inner lining of your intestines.

Bloody stools, fatigue, abdominal pain, and bowel urgency are common symptoms of ulcerative colitis. While Crohns disease might skip areas of your GI tract, UC causes a more continuous inflammation and does not skip.

What Causes Crohns Disease

The causes of Crohns disease are unknown. However, it is believed to be caused by a combination of factors. Scientists state those causes are environmental and genetic. Additionally, Crohns disease can also be due to immune factors.

It results in a chronic inflammatory disorder, in which the bodys immune system defends the gastrointestinal tract, possibly targeting microbial antigens. While Crohns is an immune-related disease, it does not appear to be an autoimmune disease.

In an autoimmune disease, like Lupus, the immune system is not being triggered by the body itself. The exact underlying immune problem is not clear however, it may be an immunodeficiency state.
