Your benefit amount is calculated based on the amount of earnings you had in the highest-earning quarter of your base period, and is about 60-70 percent of your regular earnings. In 2018, the maximum amount of SDI you can receive is $1,216 per week. SDI payments are processed every two weeks.

Sick pay or PTO. Paid sick time, PTO, or holiday pay that you receive while receiving SDI will be subtracted from your SDI benefit amount, as will wages for part-time work . You can ask the EDD to “integrate” the SDI benefit with your sick pay or PTO, however. If your employer agrees, your employer can pay you just enough sick time or PTO so that, when combined with SDI, you will be receiving the same amount as your normal salary or wages. On your application form, you write “Integrated Benefits” for the type of pay you are receiving from your employer.

In addition, you may receive sick time or PTO for the first seven days of your disability, since SDI will only start paying you on the eighth day.

Paid vacation. Receiving paid vacation benefits will not affect your SDI payment.

What If I Attempt To Return To Work But I End Up Needing To Go Out On Disability Again

If you return to work and are able to perform your regular or customary job for more than 60 days, then your disability benefit period is considered ended. If you stop working again due to disability, you must file a new claim for SDI, and re-establish your eligibility for benefits as of the date of the new claim. If you are eligible for SDI as of the date of your new claim, you are entitled to a new benefit period of up to 52 weeks.

If you return to work for more than 60 days, but do not perform your regular or customary work due to your disability for example, you work only light duty or only part-time you may be able to continue your prior disability claim. You will need to show EDD that you did not perform your regular or customary work when you attempted to return to work.

If you return to work for fewer than 60 days, and stop working due to the same disability, you are considered to be within the same disability benefits period. You may continue receiving benefits under your original claim and the 7-day waiting period required by these claims will be waived.

Employment Department Flooded With Calls

The deluge of calls began in late 2021. In December, the department said it was taking action to halt suspected organized criminal elements filing false disability insurance claims. Californias disability insurance replaces some wages for people who are unable to work due to illness, injury, or pregnancy, and medical providers certify the existence of a disability.

The agency had experienced a massive surge of new medical provider accounts and suspected many were fraudulent, said department spokesperson Gareth Lacy in an interview with CalMatters. Typically, the department received 70 new medical provider registrations per week, but during four weeks from late November to early December, they received about 30,000, Lacy wrote in an email.

To sift through the influx of claims, verify medical provider and claimants identities, and answer an uptick in calls, the roughly 1,000 staff in the disability branch worked 22,000 hours of overtime per month from December 2021 to May 2022. Thats ten times the normal monthly overtime average, according to Lacy. The disability branch also borrowed 133 employees from other branches of the department, and brought back nine retired employees to help with the additional work, according to Lacy. To confirm the identities of claimants and doctors, staff sent out emails and letters, he said.
