CBO projects that the number of new recipients age 67 and older will decline in the coming years as the share of the veterans’ population in that age group falls. Concurrent Retired And Disability Pay

Veterans who are rated as 90 percent disabled may qualify for concurrent retired and disability pay . Importantly, CRDP restores your service pay simply by eliminating the VA waiver*. Veterans will not receive a separate check for CRDP. Instead, the monthly check they receive from the Defense Finance and Accounting Service , the administrator of military retired pay, will be increased from the docketed amount to their full retired pay. Since it is a direct restoration of the VA waiver, CRDP essentially counts as service retired pay. There is no application process for CRDP. If veterans meet the eligibility requirements, DFAS will automatically eliminate the VA waiver, thereby restoring retired pay.

To be eligible for CRDP, veterans must:

• Be receiving retired pay and VA compensation
• Be a 20-year retiree and
• Have a service-connected condition rated 50 percent or higher.

*Note: Veterans who receive both service retired pay and VA disability compensation simultaneously are required to waive part of their service retired pay. The amount the veteran receives in VA compensation is subtracted from the amount they receive in retired pay to avoid double-dipping. This subtraction constitutes the VA Waiver.

Disability Ratings Are Awarded On A Case By Case Basis

To rate a disability claim, the VA first tries to determine whether or not you sustained your illness or injury in military service. Then, they assign a rating for each illness or injury.

If the VA determines your injury or illness isnt related to your military service or didnt happen while you were in the military, they will deny your claim. If the VA approves your claim, they will assign it a rating between 0% 100%.

A 0% rating shows there is an illness or injury that is connected to your military service, but it doesnt warrant compensation at this time. It is still good to get a 0% rating compared to no service-connected link because if the condition worsens at a later date, you can apply to have your disability rating upgraded.

Fill out VA Form 21-2680 and mail it to the PMC for your state. You can have your doctor fill out the examination information section.

The Va Disability Rating System Explained

The VA uses a disability rating system to assign a percentage to the severity of your disability, using a scale that measures from 0-100% and rises incrementally by 10%. This rating then determines your benefit amount. The VA determines your rating through an internal review of your health and medical history, going over a combination of service treatment records, VA medical records, and private medical records that are directly related to your disability. Your rating will be based on a single diagnostic code per condition, even should that condition meet more than one diagnostic code.

If you have more than one disability, you can use the combined-rating system to find your benefit amount.

A Note On Va Ratings And Va Healthcare

We mention specific VA healthcare benefits and qualifications at each disability rating percentage. Higher ratings may offer more benefits.

However, its important to note that as a veteran, you may have access to VA healthcare even if you dont have a VA rating, depending on your income. Some services never require a copay. These include:

• Any care for a service-connected disability
• Care and counseling for military sexual trauma
• Compensation and Pension exams
• Care as part of a VA research project
• Readjustment counseling and related mental health services
• Care for cancer of the neck or head caused by nose or throat radium treatments during service
• Smoking cessation and weight-loss services

A Change In Your Family Status Can Change Your Va Disability Payment

Remember to contact the VA whenever you have a change in family status as your rates may change as well.

If you have a 30% disability rating or higher and you are also supporting qualified dependents such as a spouse, child, or parent, you may be eligible to receive a higher VA disability payment.

If your disability rating is 20% or lower, changes in your family status should not affect your VA disability payment rates.

The VA will not know when there is a change in your family status, so you will need to inform them immediately when something changes, like a birth, wedding, a parent moving in with you, divorce, a child coming of age, or the death of a qualified dependent.

Inform the VA of a change as soon as possible.

The VA will sometimes backdate payments to make up for any shortfalls, like if you had to wait for your child to receive a social security number to report a new dependent.

In the case of the loss of an eligible dependent, your payment may decrease. The VA can recoup overpayments if you failed to notify the VA of a change in family status in a timely manner.

Applying For Va Compensation Benefits

When applying for VA benefits, supply as much supporting information as possible, including how the injury or illness occurred, any medical treatment you received, current health status, and how your life has been affected by the injury or illness.

You will need to fill out VA Form 21-526, Veterans Application for Compensation and/or Pension, or apply online using VONAPP. Be sure to provide a copy of your DD Form 214.

There are many organizations that specialize in helping veterans with their benefits and claims.

The first place to start is with the VA. VA representatives have access to your records and are the best source for up-to-date information.

However, the VA isnt always the best place to get assistance with your claim, especially if you are filing an appeal after the VA denied your claim. In that case, I recommend contacting a veteran benefits counselor at your county VA office, or an organization such as the DAV, AMVETS, VFW, American Legion, or a similar Veteran Service Organization.

If that doesnt work, consider hiring a lawyer that specializes in VA disability claims.
